Terms of Use

These Terms form a binding contract between you and STARHASH. You represent that you have full legal capacity and, when using the Platform on behalf of a company, that you are authorized to bind it. Specific terms for plans, campaigns, or features may supplement these Terms and, in case of conflict, prevail as to the subject they govern.

• "Influencer": a natural person who creates and makes available their digital representation on the Platform.
• "Company" or "Brand": a legal entity that contracts digital representations for campaigns and content.
• "User Content": images, text, and other materials you upload to the Platform.
• "Outputs": visual content generated by the Platform from User Content and prompts.
• "Starcoins": prepaid units consumed to generate content on the Platform. The purchase is final: Starcoins are not convertible back into cash, except where the law requires.

• You must be at least 18 years old to use the Platform.
• You are responsible for keeping your credentials confidential and for all activity on your account.
• You must provide true, complete, and up-to-date information and keep it current.
• Notify us immediately of any unauthorized use of your account.

STARHASH is a marketplace that connects influencers and companies and provides AI-assisted tools to create digital representations and generate visual content (poses, outfits, and scenes) while preserving the influencer’s identity and natural marks.

We may modify, suspend, or discontinue Platform features at any time. We will make reasonable efforts to communicate material changes.

The Platform intermediates the relationship between influencers and companies. Unless expressly stated otherwise, STARHASH is not a party to the campaign contracts entered into between them; we act as the technology and intermediation provider, and may manage Starcoins, payouts, and content delivery according to the contracted plans.

• The influencer authorizes, within the limits they set, the use of their digital representation in contracted campaigns.
• The company is responsible for its use of the Outputs across its campaigns and channels.

You retain ownership of the User Content you upload. By uploading it, you grant STARHASH a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process that content, including via AI models, solely to operate the Platform and provide the services to you.

You represent and warrant that: (i) you hold all necessary rights to the User Content, including image rights; (ii) the content depicts you or a person who has expressly authorized the use of their image; and (iii) the content does not violate third-party rights or the law. Processing of images and biometric data follows our Privacy Policy and depends on your specific consent.

Subject to compliance with these Terms and payment due, we grant you the rights to use the Outputs generated from your User Content, including commercial use in authorized campaigns and channels, to the extent permitted by applicable law.

• Outputs are AI-assisted creations and may not be eligible for exclusive copyright protection under applicable law; similar outputs may be generated for other users from different prompts.
• You are responsible for using Outputs lawfully and without misleading the public about the nature of the content, per our Acceptable Use Policy.
• STARHASH may retain technical copies of Outputs for operation, security, and legal compliance.

• Generating content consumes Starcoins, purchased individually or included in the Platform subscription.
• Prices and the number of Starcoins per operation are shown on the Platform and may vary by feature.
• Payments are processed by third parties; by contracting, you authorize charges via the methods provided.
• Refund, renewal, and cancellation policies are detailed in our Refund & Payments Policy.
• Applicable taxes are your responsibility, except where the law assigns collection to STARHASH.

You agree to use the Platform lawfully and in accordance with our Acceptable Use Policy, which is part of these Terms. Among other things, you may not generate content using a third party’s likeness without authorization, or content that is misleading, unlawful, or rights-infringing.

The Platform, its brand, software, design, models, and other elements are owned by STARHASH or its licensors and are protected by law. These Terms transfer no rights to you over those elements, except the limited license to use the Platform set out here. You may not copy, decompile, reverse engineer, or exploit the Platform beyond authorized use.

We may review, moderate, and remove content, and suspend accounts, where there is evidence of a breach of these Terms, the Acceptable Use Policy, or the law. We maintain a notice-and-takedown procedure: rights holders may report violations at [email protected], and we will act in accordance with applicable law.

The Platform is provided "as is" and "as available." To the maximum extent permitted by law, we do not warrant that the service will be uninterrupted, error-free, or that Outputs will meet specific expectations. Statutory warranties and consumer rights are not excluded where they cannot be waived.

To the maximum extent permitted by law, STARHASH is not liable for indirect damages, lost profits, or data loss arising from use of or inability to use the Platform. STARHASH’s total liability, where applicable, is limited to the amount you paid for the services in the 12 months preceding the event giving rise to liability. This clause does not exclude liabilities that cannot be limited by law.

You agree to indemnify and hold STARHASH harmless from claims, losses, and expenses (including reasonable fees) arising from your use of the Platform in violation of these Terms, the law, or third-party rights, particularly the unauthorized use of likeness.

You may close your account at any time. We may suspend or terminate access for a breach of these Terms, risk to the Platform, or legal requirement. Upon termination, the licenses granted cease, except for provisions that by their nature survive termination (such as intellectual property, limitation of liability, and jurisdiction).

We may update these Terms. The version in force is the one published on this page, with the "Last updated" date. Material changes will be communicated by reasonable means. Continued use after changes take effect represents agreement.

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of [CITY/STATE] are elected to resolve disputes, without prejudice to the consumer’s home jurisdiction where consumer law applies.

• Assignment: you may not assign these Terms without our consent; we may assign them in corporate transactions.
• Severability: the invalidity of one clause does not affect the others.
• No waiver: not enforcing a right does not mean waiving it.
• Entire agreement: these Terms, together with the Privacy Policy and other referenced policies, constitute the entire agreement between the parties on their subject matter.
